Grievance

Bullying & Harassment – Dignity at Work

At SimplifyHR, we are experienced in handling bullying, harassment, and dignity at work investigations. We understand that these issues require a sensitive and expert approach to ensure a respectful and compliant work environment for all.

 

Bullying
Bullying involves repeated inappropriate behaviour that undermines an individual’s dignity at work. It typically occurs over time and can be directed at an individual or a group. An isolated incident is not considered bullying.

 

Harassment
Harassment refers to unwanted conduct related to any of the nine grounds of discrimination, creating an environment that is intimidating, degrading, humiliating, or offensive.

 

Sexual Harassment
Sexual harassment is a specific form of harassment, involving unwanted conduct of a sexual nature that impacts an individual’s dignity in the workplace.

Performance or Absence

These investigations focus on concerns related to an employee’s work performance and unexplained absences. We conduct a comprehensive review of performance data, attendance records, and any other relevant information with the aim to identify any underlying issues affecting the employee’s performance or attendance.

 

The objective is to determine whether the employee requires additional support, training, a Performance Improvement Plan (PIP).  If necessary, we will guide you through implementing a PIP to help the employee improve and meet performance expectations. In cases where corrective actions are required, we ensure these are handled fairly and in line with best practices.

Protected Disclosures/Whistleblowing

At SimplifyHR, we understand the importance of addressing protected disclosures with the utmost care and attention. Protected disclosures investigations address allegations made by workers regarding potential wrongdoing, unethical behaviour, or illegal activities within the organisation.

 

In an employment context, a grievance is a complaint raised by an employee to their employer. However, not all grievances qualify as protected disclosures. A grievance that is purely personal to the employee is unlikely to be considered a protected disclosure.

 

Examples of a Protected Disclosure

  • Unsafe working conditions, such as failure to follow health and safety protocols.

  • Misuse of company funds, fraud, or bribery.

 

These investigations are conducted with the utmost confidentiality to protect the individual making the disclosure and prevent any retaliation.
